The whole idea that someone can "own" a specific set of coding and keep anyone else from using it is rather weird. It's not like you can lose your code if someone uses it or makes some other code based off of it anyway. And if the creator of Towny isn't making money because he didn't think to use his code well or someone else made something better out of it, that's progress. People making better things off of what other people have developed is how we have such great technology, different people adding their ideas so the entirety of society ends up receiving the benefits.

Oh, and here's a nice response to a cease and desist letter you might like. :D

This baseless conspiracy has been put to bed. We personally spoke with Elgarl(the current developer of Towny). He requested some samples of our code as evidence to prove that Civcraft is an not a derivative work of towny. Some Civcraft source code was provided as evidence of original work and Elgarl was satisfied with the proof we provided.

[16:01] <netizen539> ok that worked.
[16:01] <ElgarL> cool
[16:01] <ElgarL> ok
[16:02] <ElgarL> We're not trying to ruffle any feathers here, but a C&D is a basic tool to begin protecting copyright/IP material
[16:02] <ElgarL> they are never very politre as they are legal documents
[16:02] <ElgarL> polite*
[16:03] <ElgarL> To cover a bit of background..
[16:03] <ElgarL> Civcraft was reported to us as being in breach of the Towny license
[16:03] <ElgarL> So we investigated
[16:04] <ElgarL> finding your blog post we saw you were using Towny at some point in the past adn when we looked at the current Civ server it was very simial in many parts
[16:04] <ElgarL> some parts being identical
[16:05] <netizen539> Which parts are identical?
[16:05] <ElgarL> header formatting and the map
[16:05] <netizen539> There is a header for commands, and there is a map.
[16:06] <ElgarL> if thats yoru own unique code then ther eis no issue. If however it is ported Towny code then we do have a problem
[16:06] <netizen539> But they are not identical.
[16:06] <netizen539> Your map is superior in many respects.
[16:06] <ElgarL> I did see it was trimmed down, but still the mapping part was identical
[16:07] <ElgarL> To clear this all up all we'd need is proof that the mapping and header formatting is your own unique code
[16:15] <netizen539> 1 second, I'm at work. I'll see if I can grab something from the svn for you.
[16:15] <ElgarL> ok
[16:34] <netizen539> ---- pastebin link was here ----
[16:38] <ElgarL> Yep thats different enough for me. I'm happy
[16:40] <netizen539> cool :)

Glad to see that this is all cleared up, I would hate to see civ go under.
